Chapter II. PROTECTION REGIME FOR THE BAIKAL NATURAL TERRITORY

Article 5. Basic Principles of Protection of the Baikal Natural Territory

In order to protect the unique ecological system of Lake Baikal, a special regime shall be established in the Baikal natural territory for economic and other activities carried out in accordance with the following principles:

- Priority of such types of activities that do disturb the unique ecological system of Lake Baikal and natural landscapes in its water conservation area;

- Consideration of the complex character of impact exerted by economic and other activities on the unique ecological system of Lake Baikal;

- Balanced solution to socio-economic tasks and tasks aimed at protecting the unique ecological system of Lake Baikal on the basis of sustainable development principles;

- Mandatory state environmental impact assessment.

Article 6. Types of Activities Prohibited or Restricted in the Baikal Natural Territory

1. Types of activities exerting the following negative impact on the unique ecological system of Lake Baikal shall be prohibited or restricted in the Baikal natural territory:

- Chemical pollution of Lake Baikal, its part, and its catchment area caused by discharge and emissions, use of pesticides, agrichemicals, and radioactive substances, by transport operation, and by dumping of production and consumption waste;

- Physical change in the state of Lake Baikal or its part (change of temperature conditions of water, fluctuation of water levels beyond admissible limits, change of inflows to Lake Baikal);

- Biological pollution of Lake Baikal caused by the use, breeding, or acclimatization, in Lake Baikal or water bodies permanently or temporarily joined to the lake, of water biological objects foreign to the ecological system of Lake Baikal.

2. Without a positive conclusion of the State expert examination of relevant design documents, any construction of new or reconstruction of current economic facilities in the Baikal natural territory shall be prohibited.

3. The list of activities prohibited in the central ecological zone shall be approved by the Government of the Russian Federation.

Article 7. Water Regime of Lake Baikal

For the purpose of protecting the unique ecological system of Lake Baikal and preventing any negative impact of economic or other activities on its condition, the following requirements shall be set in respect of Lake Baikal water regime:

- The regime for filling and operating of Lake Baikal shall be determined by a competent federal executive authority in the manner prescribed by the legislation of the Russian Federation;

- Ban on raising the water level in Lake Baikal above the permissible maximum and lowering the level below the permissible minimum established by the Government of the Russian Federation.

Article 8. Specifics of Protection, Catching (Harvesting) of Endemic Species of Aquatic Animals, and Collection of Endemic Species of Aquatic Plants

For the purpose of protecting Baikal omul, Baikal seal, and other species of aquatic animals, as well as species of aquatic plants unique only to Lake Baikal (hereinafter, the endemic species of aquatic animals and plants), with the exception of animals and plants registered in the Red Book of the Russian Federation, the Government of the Russian Federation or a federal executive authority approved by the Government shall set the permissible level for catching (harvesting) of Baikal omul, seal, and other endemic species of aquatic animals and for collecting endemic species of aquatic plants, as well as time-frames and a list of fishing gears for catching Baikal omul, time-frames and a list of harvesting gears for harvesting Baikal seal, and time-frames for collecting endemic species of aquatic plants.

The specifics of catching (harvesting) Baikal omul, seal, and other endemic species of aquatic animals, as well as of collecting endemic species of aquatic plants shall be determined by the Government of the Russian Federation.

Article 9. Territories of Traditional Environmental Management within the Baikal Natural Territory

1. Territories of traditional environmental management shall be established within the Baikal natural territory in the manner prescribed by the legislation of the Russian Federation.

2. Relations arising in connection with the use of land and other natural resources in the territories of traditional environmental management in the Baikal natural territory shall be governed by the legislation of the Russian Federation in compliance herewith.

Article 10. Specifics of Land Use in the Central and Buffer Ecological Zones

The land in the central and buffer ecological zones shall be used by individuals and legal entities subject to requirements hereof.

Article 11. Specifics of Use, Conservation, Protection, and Regeneration of Forests in the Central Ecological Zone

1. The following shall be prohibited in the central ecological zone:

1) clear cutting;

2) transfer of forest reserve lands with protective forests to other categories of land.

2. The priority in regeneration of forests in the central ecological zone shall be placed on valuable forests.

3. Use, conservation, protection, and regeneration of forests located in the central ecological zone shall be carried out in compliance with forest legislation.

Article 12. Organization of Tourism and Recreation in the Central Ecological Zone

1. Tourism and recreation shall be organized in the central ecological zone in compliance with the rules that ensure the observance of environmental load limits applied in the central ecological zone.

2. The rules for tourism and recreation in the central ecological zone shall be approved by public authorities of the Republic of Buryatia and of the Irkutsk Region.
